Cross-Brand Compatibility: Affiliates must maintain a commitment to promoting the Weed & Wellness brand in a positive and professional manner. Cross-brand compatibility with other companies or programs that are not compatible with the Weed & Wellness brand may not be allowed.
Proper Use of Trademarks: Affiliates may use the Weed & Wellness name and trademarks only as expressly authorized in writing by Weed & Wellness.
Compliance with Laws: Affiliates must comply with all applicable laws and regulations in connection with their participation in the Weed & Wellness affiliate program.
Ownership of Customer Information: All customer information collected through the affiliate program belongs to Weed & Wellness and cannot be used or disclosed by the affiliate for any other purpose without the express written consent of Weed & Wellness.
Non-Compete Clause: Affiliates may not operate or participate in any other business, program or product that competes with or is similar to the Weed & Wellness affiliate program without prior written consent from Weed & Wellness.
Termination: Weed & Wellness may terminate an affiliate's participation in the program at any time, for any reason, with or without notice.
Liability: Affiliates assume all liability for any damages or losses that may result from their participation in the Weed & Wellness affiliate program, and agree to indemnify and hold Weed & Wellness harmless from any claims or damages arising out of their actions as an affiliate.
Confidentiality: Affiliates must maintain the confidentiality of all information provided to them by Weed & Wellness, including but not limited to customer information, business information, and marketing materials.
Selling Merchandise: Affiliates may sell merchandise that meets the following criteria:
Merchandise must be purchased from a Weed & Wellness-approved vendor or licensee.
Merchandise must not bear any unauthorized Weed & Wellness branding or intellectual property.
Affiliates may not use the Weed & Wellness name or logos to create their own apparel or merchandise, unless specifically authorized in writing by Weed & Wellness.
All merchandise sold by affiliates must comply with applicable laws and regulations related to cannabis, including but not limited to requirements related to packaging, labeling, and licensing. Affiliates should consult with their local regulatory authorities to ensure compliance with all applicable laws and regulations.
Merchandise sold by affiliates must align with the focus of the Weed & Wellness brand and promote safe and responsible use of cannabis in connection with health and wellness.
Governing Law and Jurisdiction: The Weed & Wellness affiliate program agreement shall be governed by and construed in accordance with the laws of the state or province of Weed & Wellness's principal place of business. Any disputes arising under or in connection with the agreement shall be resolved exclusively by the state or federal courts located in the same jurisdiction.
